Doctor Online, Inc. Terms and Conditions These Terms and Conditions of Use (hereinafter referred to as the “Terms of Use” or the “Conditions of Use”) must be fully read and accepted by the User in order to access and use the Services detailed below.
Doctor Online, Inc. here in after also referred to as “Doctor Online, Inc..” or “The Company,” manages one or more portals, platforms, and web applications to facilitate remote services, which the “User” voluntarily requests and which will be provided by Doctor Online according to the terms and conditions agreed upon herein.
The “User” understands and agrees that “The Company” does not provide any type of medical or health service but only provides the platform and tools for communication between the User and Mental Coaches. All Mental Coaches who may attend to your request are independent coaches (hereinafter referred to interchangeably as “Coaches” “Mental Coaches” “Treatment Providers,” or “Treatment Professionals”) who offer their services in the free exercise of their profession and use Doctor Online, Inc. as a means to communicate with the User.
The portals, platforms, tools, and web applications owned by The Company may hereinafter be referred to interchangeably as “The Site” or “The Platform.”
Doctor Online, Inc. and the independent Coaches who participate do NOT provide a mental diagnosis or treatment. The responses provided by the Mental Coaches are for informational and guidance purposes ONLY. The content of the responses provided by the Coaches through the Doctor Online, Inc. platform does NOT replace any type of Mental Health nor constitutes a Professional-Patient relationship.
The Coaches will provide their recommendations and guidance according to the information provided by the User, so the User expressly agrees that the information provided is truthful. The content of the information, recommendations, and/or guidance provided is not the responsibility of the independent coachesif the information, symptoms, and history provided by the User are inaccurate, false, or omit relevant data or information.
In case of an emergency, the User or the third party for whom information is being requested must always go to the nearest health service center or hospital. Failure to follow this recommendation may put your life or integrity at serious risk.
Any type of information, recommendation, indication, possible diagnosis, or treatment recommended by a “Mental Coach” through the Doctor Online, Inc. platform comes exclusively from that professional and in no case from “The Company,” which will not be responsible for any damage or harm related to or derived from diagnoses, possible diagnoses, recommendations, guidance, treatments, or mental coach obtained from the Mental Coaches providing their service through the Doctor Online, Inc. platform. Therefore, by accessing this website, application, or platform of Doctor Online, Inc., the User as the beneficiary of the service expressly waives any direct or indirect action, of any kind, that may have against “The Company” due to the personal and direct relationship with the “Mental Coaches” that the User has chosen to consult. The User also irrevocably accepts that, in the unlikely event of malpractice, “The Company” is exempt from any responsibility, as it is understood that this website is only a platform that facilitates communication between the User and the “Mental Coach” For this purpose, the user also declares knowledge of and acceptance of the following definitions:
1. Use of the Site. Doctor Online, Inc. (“Doctor Online, Inc.,” “we,” or “our”) operates the website located at www.doctor-online.us and other related websites and mobile applications with links to these Terms of Use (collectively, the “Site” or the “Platform”). We offer a platform to provide online telemedicine services (the “Services”) that allow our members (“Members”) to report their health history and communicate with mental coach professionals to receive general mental coaching recommendations and guidance. By accessing and using the Site, you agree to be bound by these Terms of Use and all other terms and policies posted on the Site, on your behalf and on behalf of the minors you represent. If you do not agree or do not wish to be bound by any of these Conditions of Use, you will not be able to use the Site or the Services.
2. Coaching Services. All Treatment Professionals providing services through the Doctor Online, Inc. Platform are independent professionals who are solely responsible for the services they each provide to the User. Doctor Online, Inc. does not practice psychology or any other licensed profession, nor any type of health service, and does not interfere with the practice of medicine or any other licensed profession by the Treatment Providers, each of whom is responsible for their services and compliance with the requirements applicable to their profession and respective licenses. Neither Doctor Online, Inc. nor any third party promoting the Services or providing you with a link to the Service will be responsible for any professional advice you receive from a Treatment Provider through the Services or the Site.
3. Site Content. No content on the Site or message sent from the Site should be considered as mental advice or an endorsement, representation, or guarantee that any particular medication or treatment is safe, appropriate, or effective for you as a User.
4. Informed Consent.
• A. Mental Coaching is the provision of mental coaching services using interactive audio and video technology, where the User and the Mental Coach are not in the same physical location. During your Coaching consultation with a Mental Coach, the details of your health history and personal health information may be discussed through the use of interactive video, audio, and other telecommunications technologies, and in some cases, the Mental Coach attending to you may conduct a physical examination through these technologies.
• B. The accuracy of the information provided will be the User’s absolute commitment. The Mental Coach services that the User receives from the Mental Coach are not intended to replace a primary care Psychologist relationship or be your permanent doctor.
• C. The User must seek emergency help or follow-up care when recommended by the Mental Coach or when otherwise needed and continue consulting with their primary care physician and other health professionals as recommended. WheMental Coach advises the User to seek emergency help by going to a hospital, health center, specialist doctor, or similar, and if the User does not follow that recommendation, neither Doctor Online, Inc. nor the Mental Coach who attended to you will be responsible.
• D. As with any health service, there are potential risks associated with the use of Mental Coaching. These risks are expressly accepted by the User, including, but not limited to, the following:
◦ Cases where the transmitted information may not be sufficient (e.g., poor image resolution) to make appropriate healthcare decisions by the Mental Coach;
◦ Delays in evaluation or treatment could occur due to electronic equipment failures. In such cases, other types of communication between the parties may be conducted via telephone and other means.
◦ At times, the lack of access to the full health records or the omission, inaccuracy, or falsity of the information provided by the User may result in adverse or other errors in judgment;
◦ Although electronic systems incorporate network and software security protocols to protect the privacy and security of health information, in rare cases, security protocols could fail, causing a breach of personal health information privacy.
5. Acceptance of these terms: By accepting these Terms of Use, as a User, you acknowledge that you understand, expressly accept, and agree to the following: • You understand that you may anticipate the benefits of using mental coaching in your care, but no outcome can be guaranteed or assured.
• Electronic communications are directed to your treatment provider(s) and their supervisors through a secure and encrypted video interface and an electronic health record.
• You understand and expressly accept that if you -the User- are accessing the Platform through a user account provided by your insurer, your personal data -or that of the minor you represent-, the content of the communications, and the recommendations may be shared with that insurer at its request.
• The Mental Coach attending to you, due to professional circumstances, may determine that the Services are not appropriate for some or all of your treatment needs and, consequently, may choose not to provide Mental Coaching services through the Site.
• You understand and expressly accept that the Mental Coach will make recommendations based on the symptoms, personal information, and medical information provided by the User, so the User expressly agrees that all data, images, and information provided, both on the Platform and to the Mental Coach, are truthful and real.
6. Privacy.
• A. As part of the provision of Services, we may need to provide you with certain communications, such as appointment reminders, service announcements, and administrative messages, whether by email, text messages, or other forms of electronic communication. These communications are considered part of the Services.
• B. The information sent by email to the User has been maintained on secure servers by Doctor Online, Inc.; once such email is sent to the email account provided by the User, Doctor Online, Inc. will not be responsible for the security and privacy of the content of the email sent, as the security of your email provider’s servers, the security of your email account, and access to it, among other circumstances, are not and will not be the responsibility of Doctor Online, Inc. or the Mental Coach who sent that email. Therefore, Doctor Online, Inc. cannot guarantee the security or confidentiality of the content of emails sent, which will be considered sent at the time.
